TERMS OF SERVICE

TERMS AND CONDITIONSBy commissioning the artist (BillyChatzo), the client agrees that he is at the Age of 18 or older (Using PayPal under the age of 18 is against PayPal’s terms of service) and the artist is not responsible if that doesn’t turn out to be the case.By purchasing commissions from the artist, the client is automatically accepting the Terms of Service and is being obligated to follow them. The purchase is for digital artwork (not prints).For Commercial use, the price will double up or more when:1. The Artwork is used for a profitable medium (Youtube, Twitch, Patreon, etc) (Price multiplied 2x)2. The artwork is reproduced and selled (merchandise, etc) (Price multiplied 3x)• The client automatically agrees that the information they provide is accurate.• The client and Artist may not share each other's personal/contact details with third parties.PAYMENT• Paypal accepted (Only through invoice).• The artist begins the creative process only after the full payment.• After a commission is canceled, no refunds will be issued unless the artist himself cancels the commission in any current phase. The client automatically accepts that the PayPal Email they provide to the artist is accurate for the refund to take place.• Withholding the artist from posting the commission art publicly requires the additional payment of 100€.ORDERING & WORK TIME• Worktime is about 20-60 days per commission (or more, depending on commission type). The client can review their commission progress by contacting me via email.• If a deadline is set for a commission by the client, that automatically affects the quality of the artwork produced. The artist holds no responsibility for an artwork's quality if the deadline is less than 21 days from the moment the commission invoice is paid. References of high quality artworks are provided in the Commission Sheet, as well as the artist's profile pages.• The artist will be providing low quality process pictures regularly, whether it is requested by the client or not.REVISION & CORRECTION• Incomplete commission information provided by the client falls completely within their legal and financial responsibility, while the artist bears none.• After the commission is finished, major revisions (e.g. structure, pose, lighting, composition, ect.) are provided only after additional payment through a new invoice to the client.• Minor revisions are standard throughout the commission process (e.g. color, pattern, size of accessories or weapon, etc).• No revision for Sketch Commissions.COPYRIGHT / USAGE POLICYFull resolution and low resolution pictures will be provided by the artist to the client with the artist's signature.As a Commissionee and Artist,
I (BillyChatzo) hold every right to the artwork to :• Publish my commission works anywhere (With credit to the copyrighted fictional character's/universe's owner).• Promote myself with the artwork.• As a Commissionee and Artist, I (BillyChatzo) claim no ownership of possible copyrighted material that might belong to the Client (e.g. Original Character/Universe) or a different party.• The Client accepts full responsibility for the case of Copyright Infringement of third party copyrighted material as the artist might be unable to have full knowledge of the copyright status or ownership of said material.As a Client with a PERSONAL USE Commission, you may :• Upload / post the low resolution art on any other platform (non-profitable medium) with proper credit to my name (BillyChatzo).• Print the art or make any merchandise for personal use and not for selling.• Decorate your non-profit profile pages, profile pictures, or any other personal account.A Client with a PERSONAL USE Commission is NOT allowed to:• Redistribute, reproduce, repost, make merchandise of, or otherwise profit from the commissioned artwork with physical or digital currency.• Post the Full Resolution drawing publicly.A Client with a PERSONAL OR COMMERCIAL USE Commission is NOT allowed to:• Change or modify the artwork without my permission.• Claim to have created the artwork.• Remove the artist's watermark / signature / anything that refers to the artist's identity.• Feed it in any way, shape or form to AI Algorithms or Image Generation Algorithms, or associate it with anything AI related.• Redistribute the art as NFT or associate it with anything NFT related._______________________________________The client agrees to credit the Artist (BillyChatzo) at all times for any commissioned artwork in its every showcase.The artist holds no responsibility to hold onto an artwork and preserve it for extended periods of time. The commission or the storage it is saved in might spontaneously combust, break, get corrupted or deleted. It’s not the artist's responsibility to archive the client's piece.After the cancellation of a commission by the artist, financial damages of the client due to the inaccuracy of a client's provided Paypal information or other information, or due to technical issues of the domain in which the procedure takes place (or any possible issues outside the control of the artist), while the artist (BillyChatzo) has already had losses equal to a full refund for the purpose of the refund, it’s not the artist's responsibility to compensate the additional money that has been lost.Abusive, discriminatory, violating behavior, unjustified chargebacks against the Artist, attempt at fraud or violation of any term automatically means the Client's right to every work the Artist has ever created for them to be revoked while the Artist has the right to hold onto the payment and to use the copyrighted artwork for commercial purposes excluding the associated copyrighted material of the client or a third party which the Artist doesn't claim (e.g. fictional original character/universe that belongs to said parties). The Artist has the right to cease their work at any point in the process.The Artist has the right to reject any commission.Terms of Service / Rules & Guidelines can be modified.-BillyChatzo,
